1. Acceptance of Terms
By downloading, installing, or using Health Genie ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legal agreement between you and Prashanth Vaidya ("we," "us," "our"), the developer of Health Genie.
2. Description of Service
Health Genie is a health and wellness application that reads data from Apple Health (HealthKit) to provide general wellness insights. The App offers:
- A daily Vitality Score (0–100) calculated from your step count, resting heart rate, and sleep data
- AI-powered Morning Briefs summarizing your wellness trends in plain English
- Daily Nudges with personalized wellness suggestions based on your activity
- Trend charts, streak tracking, and weekly reports
3. Health and Medical Disclaimer
Health Genie is not a medical device and has not been evaluated or approved by any regulatory authority (including the FDA, CE, or equivalent bodies).
The App does not provide medical advice, diagnosis, treatment, or prevention of any disease or medical condition. The Vitality Score, Morning Briefs, Daily Nudges, and all other content generated by the App are for general wellness and informational purposes only. They are not intended to replace professional medical judgment.
You should always consult a qualified healthcare provider before making any health-related decisions, starting or stopping any exercise program, or if you have concerns about your health. Do not disregard professional medical advice or delay seeking it because of information provided by the App.
If you are experiencing a medical emergency, call your local emergency services (e.g., 911 in the United States) immediately. Do not rely on this App in an emergency.
The Vitality Score algorithm uses a weighted combination of your step count trend (relative to your 7-day average) and resting heart rate trend (relative to your 60-day average). When sleep data is available, it is incorporated at a 20% weight. These calculations are based on general wellness principles and are not validated for clinical use.
4. Apple Health (HealthKit) Integration
The App integrates with Apple Health (HealthKit) to read health data from your device. By using this integration, you acknowledge and agree to the following:
- The App requests read-only access to: step count, resting heart rate, and sleep analysis data. The App does not write any data to Apple Health.
- You control which health data categories you share with the App via your device's Health settings. You may revoke access at any time through Settings > Privacy & Security > Health > Health Genie.
- Health data read from HealthKit is processed on your device. Raw health data (step counts, heart rate values, sleep durations) is never uploaded to our servers or stored in the cloud.
- When you use AI-powered features (Morning Brief, Daily Nudge), anonymized health metrics are sent to our AI service solely for the purpose of generating personalized wellness insights. No personally identifiable information accompanies these transmissions.
- Health data obtained through HealthKit is never used for advertising, marketing, or data mining purposes, and is never sold to or shared with third parties, data brokers, or information resellers.
- The App uses HealthKit data in compliance with Apple's HealthKit guidelines and the Apple Developer Program License Agreement.
5. User Accounts and Authentication
- The App supports optional Sign in with Apple for accessing AI-powered features. You may also use the App's free features without creating an account.
- If you sign in, your account is associated with an anonymous identifier. We do not require or store your name or email address unless you choose to provide them through Apple's relay service.
- You are responsible for maintaining the security of your device and Apple ID.
- We reserve the right to suspend or terminate accounts that violate these Terms or engage in abusive behavior.
6. Subscriptions and In-App Purchases
Health Genie offers a free tier and a paid "Health Genie Pro" subscription with additional features.
- Plans and pricing: Pro is available as a monthly subscription, an annual subscription, or a one-time lifetime purchase. Current pricing is displayed on the subscription screen within the App and may vary by region. Prices are set through Apple's App Store and are subject to change.
- Free trial: Some subscription plans may include a free trial period. If you do not cancel before the free trial ends, your subscription will automatically convert to a paid subscription and your payment method will be charged. The duration and terms of any free trial are displayed before you subscribe.
- Billing: All subscriptions are billed through your Apple ID account via the App Store. Payment is charged to your Apple ID account at confirmation of purchase.
- Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
- Managing and cancelling: You can manage or cancel your subscription at any time through your Apple ID settings (Settings > [your name] > Subscriptions) or through the App Store. Cancellation takes effect at the end of the current billing period — you will retain access to Pro features until then.
- Refunds: Refunds are handled by Apple in accordance with their refund policy. We do not process refunds directly.
- Restore purchases: If you reinstall the App or switch devices, you can restore your previous purchases through the "Restore Purchases" option in Settings or on the subscription screen.
7. AI-Generated Content
Certain features of the App, including Morning Briefs and Daily Nudges, use artificial intelligence to generate personalized wellness content.
- AI-generated content is created using anonymized health metrics and general wellness knowledge. It is not reviewed by medical professionals before delivery.
- AI-generated suggestions are for general wellness purposes only and should not be treated as medical advice, diagnosis, or treatment recommendations.
- We do not guarantee the accuracy, completeness, reliability, or usefulness of AI-generated content. AI systems may occasionally produce incorrect or misleading information.
- You acknowledge that AI-generated content may vary in quality and should be evaluated using your own judgment. If any AI-generated suggestion concerns you, consult a healthcare professional.
8. Acceptable Use
You agree not to:
- Use the App for any purpose other than personal, non-commercial wellness tracking
- Attempt to reverse-engineer, decompile, or disassemble the App
- Interfere with or disrupt the App's servers, services, or infrastructure
- Use the App in any manner that could be harmful, fraudulent, or in violation of applicable law
- Misrepresent the App's output as medical advice, clinical data, or professional health guidance when sharing with others
9. Intellectual Property
- Health Genie and its content, features, design, and functionality are owned by Prashanth Vaidya and are protected by applicable intellectual property laws
- You may not copy, modify, distribute, sell, or create derivative works based on the App without prior written consent
- The Health Genie name, logo, and branding are proprietary trademarks
- You retain ownership of your personal health data at all times
10. Privacy
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you agree to the terms of our Privacy Policy.
11. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or free of harmful components; that the Vitality Score or any other metric will be accurate or reliable; or that any content provided will be suitable for any particular purpose.
12. Limitation of Liability
To the maximum extent permitted by applicable law:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, health outcomes, or profits
- Our total aggregate liability for any claims arising out of or related to these Terms or the App shall not exceed the total amount you have paid to us through the App in the twelve (12) months preceding the claim
- We are not responsible for any health outcomes, medical decisions, or actions taken or not taken based on information provided by the App
- We are not liable for any issues arising from Apple Health data inaccuracies, Apple Watch sensor errors, or third-party service outages
13. Indemnification
You agree to indemnify and hold harmless Prashanth Vaidya from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of another.
14. Termination
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Sections 3 (Medical Disclaimer), 9 (Intellectual Property), 11 (Disclaimer of Warranties), 12 (Limitation of Liability), 13 (Indemnification), and 15 (Governing Law) shall survive termination.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
16. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and may notify you through the App or by other reasonable means. Your continued use of the App after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you should stop using the App.
17. Apple-Specific Terms
The following terms apply to your use of the App as downloaded from Apple's App Store:
- These Terms are between you and Prashanth Vaidya (not Apple). Prashanth Vaidya is solely responsible for the App and its content.
- Apple has no obligation to provide maintenance, support, or warranty services for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Apple is not responsible for addressing any claims relating to the App, including product liability claims, consumer protection claims, intellectual property claims, or regulatory compliance claims.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not listed on any U.S. Government list of prohibited or restricted parties.
18. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
19. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Prashanth Vaidya regarding the App and supersede all prior agreements and understandings.
